BLACKBURN, UK: One of the most significant consumer rights appeals in recent years will be heard at the UK Supreme Court this week when two car finance lenders try to overturn a Court of Appeal judgment which made clear that it is unlawful for car dealers to get secret commission payments from lenders without first getting the customer’s fully informed consent.

The UK common law has long protected the consumer who is always seen as vulnerable against the ‘evil’ of secret commission payments where it is found that there was a duty to disclose the same due to the nature of the relationship between the parties.

Courmacs Legal, a UK law firm based in Blackburn, a market leader in consumer financial services claims is currently dealing with over 2.2 million claims in relation to motor finance mis-selling and allegations associated with civil bribery and hidden commissions.

In January 2025, the Chancellor intervened in the debate around compensating car finance victims with media reports suggesting Rachel Reeves intends to “shield” or “protect” lenders from large payouts in the name of competitiveness. The Treasury also applied to make representations in this week’s Supreme Court hearing but their application was rejected in February 2025.

“It cannot be right that the Treasury gives UK motor finance giants a free pass at the expense of millions of hard-working consumers,” said Darren Smith, Managing Director at Courmacs Legal.

Courmacs Legal believe there is real risk that consumers will be harmed if the Government follows through on this threat to potentially cap or limit the financial redress for car finance victims.

Courmacs Legal is today calling for the Government to respect the UK Supreme Court to maintain the separation of powers between the Legislature, the Executive, and the Courts.

“The idea that, where our highest courts have determined consumers have been wronged by lenders, the Government would either directly or indirectly seek to limit or reduce the redress those victims would receive at court is something which I and many in the legal profession feel strongly about. It undermines the reason why we have the separation of powers in the UK.

In relation to the millions of claims we are dealing with; our concern is that there is no political interference with the redress the victims of car finance mis-selling are ultimately due. Like all lawyers, we will abide by what the court says. We would expect in these circumstances our politicians to do the same” added Darren Smith.
